The Maria Island Walk - Terms and Conditions

BOOKINGS

When the Agent sells The Maria Island Walk product, it is the Agent’s responsibility to clearly communicate the following to the guest to ensure their understanding and acceptance of:
- Items listed in the Need to Know section at the beginning of each rate document related to the standard of accommodation and the experience we have created for the guests.
- These The Maria Island Walk terms and conditions.

Should the Agent fail to disclose any part of The Maria Island Walk booking conditions, The Maria Island Walk is entitled to recover the cost from the Agent arising from any incorrect disclosure, including the cost of any compensation paid to the customer.
The Maria Island Walk will provide a Booking reference to the Agent upon confirmation of booking.
The Agent must provide the Guest with a receipt of payment, a voucher or confirmation document which must be presented upon check-in. Without this document, customers may be charged full price for their experience and will be instructed to obtain a refund through The Agent. Details to include:
- The Maria Island Walk Booking Reference
- Agent Booking ID/voucher number
- Guest first and last name
- Product and add-on details
- Link to the Maria Island Walk’s FAQs page
- Booking Terms and Conditions
Final rooming list, arrival and departure details, meal and tour requirements are due 30 days prior to arrival.

SALES RATES

The Agent agrees to sell The Maria Island Walk product at the Sell Rates contained in the latest Rates Sheet.
Any changes in Sell Rates will be advised to agents at the earliest opportunity and reflected in the Rate Sheet.
All Sell Rates are inclusive of Australian GST and are subject to change at The Maria Island Walk's discretion.
Agents must confirm the validity of a rate, either online or with the WBL reservations team, prior to confirming the final cost to the customer.

GIFT VOUCHERS

Gift vouchers purchased directly through MIW are valid for 3 years from the purchase date. Failure to redeem the gift voucher by the expiry date shown on the certificate will render your voucher invalid. Treat your voucher like cash and take care not to lose it. Lost or stolen gift vouchers are non-refundable and replacements are not available, you will be required to purchase a new voucher. Gift Vouchers are non-refundable, not redeemable for cash, but are transferable to another person. In order to transfer a gift voucher into another customer’s name, the original purchaser must contact our Maria Island Walk team to make the change.
To redeem a Gift Voucher, call us on +61 2 9030 6216 to book a walk. Once your voucher has been redeemed, our booking conditions will apply. Where the cost of your booking is greater than the value of your voucher, you will be required to pay the difference at the time of booking.

PAYMENT DETAILS

The Agent agrees to pay WBL in accordance with the Payment Policy in this document.
If payment is not made in full, or proof of remittance received by the due date, the booking is subject to automatic cancellation.
To settle your account please pay by credit card (preferred) at or bank transfer.

Credit Card Payments

Credit card payment will attract a 1.2% merchant fee to Visa, Mastercard & 1.7% for American Express payments. Surcharges which are subject to change and are non-refundable.
You will need your four-digit booking reference found in the subject line of your confirmation email.

CANCELLATIONS BY GUEST / AGENT

Notice of a cancellation of one or more guests must be provided in writing. Email our reservations team at mariaisland@wildbushluxury.com
Cancellation notifications received 61 days or more: deposit will be refunded less a $50 admin fee and any credit card charges
Cancellation notifications received within 60 days of departure 100% of total contracted package will be retained.
No refunds will be given in the event of non-arrival, any unused services or unused nights due to flight / weather disruption.

CANCELLATIONS BY THE MARIA ISLAND WALK

MIW reserves the right to cancel any trip, due to sea conditions, minimum walk number not achieved (4 walkers) or other circumstances out of its control. We care about our guests’ holiday and value your decision to travel with us. In the rare case of cancellations, we will attempt to accommodate you on new dates. A full refund on monies received will be issued when a suitable alternative is not available. MIW will not be responsible for reimbursement of cost of flights, accommodation, hire car, meals or any other incidental costs which are or may be incurred in relation to the cancelled trip.

FORCE MAJEURE

‘Force Majeure’ means (without restriction) any event which Wild Bush Walks Pty Ltd trading as The Maria Island Walk could not, even with due care, foresee or avoid. Force Majeure covers events such as, but not limited to, adverse weather conditions, fire, flood and all similar events beyond our control. In the case of Force Majeure Wild Bush Walks Pty Ltd will not accept liability, and reserves the right to change and cancel trips. Any changes will be communicated in writing with absolute care for you in mind.

MEDICAL CONDITIONS

Trips cater to guests who can walk 10-15km per day carrying light packs of 6-8kg. MIW staff must be notified, prior to the walk, of any pre-existing or existing medical conditions, injuries or illnesses which may impact your ability to complete the walk. The Maria Island Walk may request an assessment of your medical condition from a qualified medical practitioner. Failure to adequately notify The Maria Island Walk of any pre-existing medical conditions, mobility and/or disabilities may result in cancellation of participation at any time, including after the commencement with no right to refund if said medical condition, mobility impairment and/or disability could be reasonably expected to affect the normal conduct of the trip and the enjoyment of other trip members. Participants over 70 years of age require a medical certificate prior to travel.

PUBLICATION OF THE MARIA ISLAND WALK PRODUCT & BRAND ASSETS

Prior to publishing any offers or advertisements of Maria Island products, offline or online, the agent must obtain written approval from the Maria Island Walk of the content, form and creative of the proposed offer or advertisement. The Maria Island Walk reserves the right to restrict which products may be offered or advertised by the agent and the basis or way in which the products are offered or advertised, including in relation to rates, special offers, currency, and the representation of products.
The agent must obtain written approval from the Maria Island Walk, granting the agent a licence for any offline or online use of the Maria Island Walk brand assets, including trademarks, logos and brand images.
Copy, images and video footage, produced by the Maria Island Walk is available on request.

DIGITAL CONFLICT OF INTEREST

The Agent must agree not to participate in Metasearch programs by paying to display rates for the Maria Island Walk products. Metasearch refers to lead generation platforms and websites that provide consumers the ability to comparison shop across multiple online travel agents and the Maria Island Walk's own online booking engine rates. These include, but are not limited to, Trip Advisor, Trivago, Google Hotel Price Ads, Kayak, Google Places, Google Hotels, Finder, Skyscanner and Google Maps.
The Agent must agree not to bid on any businesses, brand names and specific locations which these businesses operate in and any exact or variation of the Primary Keyword Phrases, including common misspellings, abbreviations or change in word order, in any form of paid advertising or search engines.
The Agent must agree not to use any of the Business Names, Primary Keyword Phrases listed below, or the Maria Island Walk images in page/profile names, usernames, signatures, avatars and profile shots within social media or buy, or own any domain names that contain Primary Keyword Phrases in the URL.
The Agent agrees to not use these Businesses, Brand Names and Locations in ad text or display URLs, nor shall the agent place social media adverts (Eg. On YouTube, Facebook or other channels) in a way that targets, competes or confuses users as to the origin/ownership of the activities.

Should the agent run digital campaigns that incorporate our destinations, we further require that the following combinations are placed as ‘negative keywords’ in search term campaigns. The negative keyword combinations is "Maria Island Waking Tours". Wild Bush Luxury reserves the right to revoke this agreement if changes are not made to ads that we believe are not in compliance with this criteria.

SOCIAL MEDIA POLICY

Social Media means a web or mobile-based application that allows or facilitates the creation and exchange of user-generated content including, but not limited to, Facebook, YouTube, Twitter, Instagram, Pinterest, Snapchat, Reddit, Tumblr, LinkedIn, Qzone, Weibo, WeChat, Ask.fm, Flickr, VK, Odnoklassniki and Meetup. Agents agree not to create official or unofficial pages/profiles on Social Media sites that are primarily used to promote The Maria Island Walk without express written permission; nor post comments to forums, blogs, Social Media or review sites that insinuate that the agent is an official representative of the WBL business.
